Developer must overcome own words in murder trial (AP)

ORLANDO, Fla. ? For developer Bob Ward to convince jurors that his wife killed herself in the wealthy neighborhood they shared with Tiger Woods and other celebrities, he will have to overcome a tough witness: himself.

"I just shot my wife," Ward calmly told a 911 dispatcher minutes after a bullet to the head killed Diane Ward in the master bedroom of their $4.3 million mansion in the Orlando suburb of Isleworth.

"You just what?" the dispatcher asked.

"I just shot my wife," Ward repeated. He uttered those words a total of five times in the recording jurors heard at the start of his trial this week.

Ward is accused of fatally shooting his 55-year-old wife in September 2009, days before she was to give a deposition in a lawsuit alleging that he blew millions of dollars on big houses and expensive cars while his business failed. His trial on second-degree murder charges is being held in the same courthouse where Casey Anthony was acquitted of murder this summer in the death of her 2-year-old daughter.

Ward contends that his wife was suicidal. At the start of the trial Thursday, his lawyer said Ward was trying to take the gun away from his wife when it went off. Toxicology reports showed that Diane Ward had antidepressants and alcohol in her body before she was killed.

During the 911 call, a dispatcher asked, "Sir, did you purposely do this or was it an accident?" Ward answered, "It was an accident."

Prosecutors said it would have been difficult for Diane Ward to have shot herself, citing gunshot testing that shows the bullet was fired from 18 inches away.

During testimony Friday, Ward averted his eyes when prosecutors showed images of a lifeless Diane Ward lying on the floor. Jurors also were shown the gun, but were told that crime-scene investigators had been unable to pull fingerprints from it.

Bob Ward's company, Land Resource, filed for bankruptcy almost a year before his wife died. He was being sued by an insurance company that accused him of taking more than $20 million from the sale of lots in subdivisions he was building in Tennessee in 2007. The insurance company, which had issued bonds for the subdivisions, said Ward should have used the money to improve the subdivisions, but instead paid off debts and went on a spending spree.

The lawsuit says the Wards used the money to buy their 8,800-square-foot mansion in Isleworth, the same neighborhood where Tiger Woods had his notorious SUV crash. The suit says the couple also paid off two loans totaling nearly $2.5 million for two houses in Georgia, bought a house on the Georgia coast for $750,000 and purchased several vehicles, including a $140,000 Mercedes-Benz sedan. The lawsuit was dismissed last month because of a lack of action by either side.

Ward's behavior after his arrest also raised eyebrows. A jailhouse video of a visit from his daughter and sister-in-law just days after the shooting showed him cracking jokes and laughing. But Ward's two daughters are supporting their father and were in the courtroom at the start of the trial.

One of his daughters, Mallory Ward, testified that her parents loved each other. She recalled her mother telling her about a month before her death, "Your father is the best man I've ever known."

The trial was expected to last two weeks.

I thought I could handle being with the boyfriend on a long distance relationship since I?ve been on so many of them I?m used to having the person I care about being far away, but this time, I can?t handle it.

I saw a cute couple sitting across from me on the shuttle bus going back to my hotel and I think about me and the boyfriend, and I just crashed in my mind. I crashed so hard that I wanted to burst into tears.

Today is our ten month?anniversary?well we aren?t really celebrating it, but we?acknowledge?it since this will be the longest relationship we both have ever been in and it?s the first relationship I ever experienced what love is.

I wish I could describe this feeling I feel for him, but I can?t. It?s something you have to just experience and when you do you?ll know what it is as soon as you feel it.

Anyway, the bf and I have been dating since November and I met him at my old school. So we spent practically everyday together and I actually got to experience a real close relationship instead of these online ones I was getting into and that random mishap where I was dating someone who lived in my town, but never saw him. Seriously, he was five minutes up the road and he couldn?t even bother to see me or something.

Sorry about that small little rant.

Anyway?

I?m so upset right now.

I cried into my pillow just now and I have this overwhelming feeling to just leave my school now. I don?t want to be here. I want to be in my old school. I want to be with the man I love. I want to feel him close to me.

I just want him close?

I?m so used to having him near by and doing cute little boyfriend things for me. I knew I would miss him, but I didn?t think it would hurt this much. I wasn?t prepared for this and didn?t think I could feel this way either.

I?m not the type to be affectionate guys. I?m not even that way with my family. And I barely hug and kiss the bf on a whim. He?s almost always the one who starts it. There are moments when I will initiate the stuff, and that?s when you know I really mean it, because I just don?t do it. I can?t for whatever reason. My brain finds it strange, but when I do get in that mood, I really mean it.

My chest feels funny, my heart is racing.

The one thing I?m afraid of is losing him.

I hope I never have to experience that, because I know deep down, he?s going to be the man I marry.

If it doesn?t happen, so be it.

Wounded grizzly kills hunter in remote Montana

(AP) ? A grizzly bear wounded by a hunter later attacked and killed the hunter's partner Friday after the two men tracked the animal in a remote area along the Idaho-Montana boarder, authorities said.

Steve Stevenson, 39, and Ty Bell, 21, members of a hunting party from Winnemucca, Nev., were going after black bears when the attacked occurred about 10 a.m. PDT in a mountainous, heavily forested region in Lincoln County, Mont., near the Canadian border.

Bell shot and wounded a young male grizzly, believing it to be a black bear, undersheriff Brent Faulkner said.

"They tracked the bear into an area of heavy cover where Mr. Stevenson was attacked by the wounded grizzly bear," Faulkner said in a news release late Friday.

"Mr. Bell was able to shoot the bear multiple times, eventually killing it," he said.

Bell used his cell phone to call for help but Stevenson died from his injuries, Faulkner said.

The area is extremely remote, with no roads and poor communications, said Ron Aasheim of the Montana Department of Fish, Wildlife and Parks. Authorities reached the scene in helicopters.

"This is big-time back country," he said. "There are no roads even close to this thing."

Authorities said the two were part of a four-person hunting party going after black bears in the area when the attack occurred. Faulkner said the party had split up earlier into two-member teams.

The incident is under investigation. It is illegal to kill a grizzly bear, which is listed as threatened in the Lower 48 states. There was no immediate word if Bell would face any charges.

This is at least the third man killed by a grizzly since July. In late August, a grizzly bear in Yellowstone National Park, some 400 miles south of here, mauled a Michigan hiker to death. In July, a female bear with cubs in Yellowstone attacked a couple from California, killing the man before fleeing.

This attack comes as Idaho's congressional delegation has proposed amending the Endangered Species Act to clarify that it is legal to shoot a grizzly bear in self-defense or in defense of another person.

The legislation was in response to the case of a northern Idaho man who shot and killed a grizzly cub in May after it and two other cubs wandered onto his property.

Jeremy Hill, 33, was charged with a federal crime of killing a federally protected species, but the case was dropped last week and he paid a $1,000 fine for a noncriminal infraction.

Panettiere honored for DC statehood advocacy (AP)

WASHINGTON ? Actress Hayden Panettiere was born and raised in upstate New York, lives in Los Angeles and has no roots in the nation's capital. But she's passionate about securing full representation in Congress for District of Columbia residents.

That's what led Panettiere to the John A. Wilson Building, the district's city hall, where Mayor Vincent Gray proclaimed Friday as "Hayden Panettiere Day."

"It doesn't get much cooler than that. It's a huge honor," Panettiere said. "We'll continue just chipping away at the problem and trying to fix it."

Panettiere, 22, who played a cheerleader with superpowers on the NBC drama "Heroes," has been speaking out since 2008 for D.C. statehood. Before then, she said she was unaware that the district had no voting representatives in Congress.

"It seems like such (an) unfathomable fact that, you know, it's taxation without representation in D.C., and that there's no democracy in our democracy, at the heart of it," said Panettiere, who looked the part of a lobbyist in a conservative black suit with her blond hair tied back.

After her private meeting with the mayor, Panettiere spoke in the cramped basement office of her friend Paul Strauss, one of the district's two shadow senators. Strauss' elected position comes with no salary and a responsibility to lobby for the district.

Panettiere, a spokeswoman for the conservation campaign Save the Whales Again!, met Strauss at a Barack Obama campaign appearance. She asked him to vote for the group's anti-whaling bill only to learn that he had no vote.

"At that point, a lot of folks who are advocating sort of stop and will move on to the next politician in the room," Strauss said. "She was different."

Panettiere, whose movie credits include "Remember the Titans" and "Scream 4," was scheduled to appear at a fundraiser later Friday to benefit the D.C. Statehood Fund.

The mayor was arrested in April along with other city leaders while protesting what they called unjust meddling by Congress in local affairs. Panettiere, who brushed with authorities while trying to stop a dolphin hunt in Japan, said Gray's willingness to go to jail shows the seriousness of the issue.

"I was very impressed," she said. "I tried my hardest to get arrested in Japan, to no avail."

Libyan veteran prepares assault on pro-Gaddafi bastion (Reuters)

NORTH OF BANI WALID, Libya (Reuters) ? Fighters loyal to Libya's new rulers will resort to heavy weapons to capture a desert town held by Muammar Gaddafi's forces if needed, a senior military commander said on Wednesday, urging civilians to flee.

Daw Saleheen, who leads regional forces battling for control of Bani Walid, said Gaddafi loyalists had positioned rockets and mortar launchers on civilian houses in the town, 180 km (110 miles) south of Tripoli.

Saleheen said his men would have to face about 1,200 pro-Gaddafi fighters, including 200 snipers perched on rooftops.

"We know all their positions. We have sent a message to all civilians that if they can, they must leave now," he told reporters on the northern outskirts of Bani Walid, his home town.

Hundreds of residents have poured out of the town in the past three days in cars crammed with children and possessions. A convoy of around 160 families left on Wednesday.

Residents say street battles and severe food and fuel shortages have made it impossible to stay.

Machinegun fire rang out around the town as anti-Gaddafi scouting squads, sent in to collect information ahead of a full-scale offensive, fought loyalist militiamen on the outskirts.

Along with Gaddafi's hometown of Sirte on the Mediterranean coast and Sabha, in the southern desert, Bani Walid is one of the last major pro-Gaddafi strongholds in Libya.

Forces backed by the National Transitional Council (NTC), the country's interim rulers, have met stronger resistance in Bani Walid than expected. They had initially estimated pro-Gaddafi forces in the low hundreds.

"If they use heavy weapons we will do the same," Saleheen said, declining to say when the fighting would start, saying only that civilians would have enough time to get out.

ROAD SABOTAGED

Saleheen knows how difficult it is to take control of Bani Walid's parched hills and valleys. He helped lead an uprising against Gaddafi there in 1993 and spent the next 18 years in prison when it was crushed.

"This area is thinly populated but it is difficult terrain because of the mountains," said Saleheen, who was released on February 19 near the start of Libya's unrest.

The central, densely populated part of Bani Walid is proving difficult to capture, NTC fighters say. It is on higher ground, allowing pro-Gaddafi forces to take aim from above.

Fighters were reported to have covered the road to central Bani Walid with oil, impeding the NTC's advance.

Saleheen said about a quarter of the town's 100,000 residents had left but many were trapped.

NTC forces have encircled the town and Saleheen said they were sure Gaddafi's son Saif al-Islam was hiding there along with the ousted strongman's spokesman Moussa Ibrahim and domestic security official Tohami Khaled.

"We have eyes inside the city," he said.

Gaddafi's whereabouts are unknown, but his spokesman, in a telephone call to Reuters on Wednesday, said the 69-year-old was still in Libya.

Bani Walid's population, dominated by the Warfalla tribe, benefited from Gaddafi's oil-fueled largesse. Talks with tribal elders aimed at a peaceful settlement have repeatedly broken down.

"A number of people in Bani Walid are against the revolution because Gaddafi gave them money and cars and also benefits for unemployed young men," Saleheen said.

"The tribal leaders prefer not to fight and surrender ... but some were close to Gaddafi so they are resisting."

NTC commanders said they were on the lookout for pro-Gaddafi fighters trying to slip out of Bani Walid before the onslaught, and were halting cars at checkpoints to search for weapons.

They also checked the identities of people leaving against a "blacklist" of around 90 names.

Atiya Yousef, checkpoint official on the northern outskirts of Bani Walid, said the list contained "Gaddafi militiamen, thieves and murderers."

"We are checking every car," he said.

"The blacklist includes people involved in any pro-Gaddafi activity, including volunteers."
