Texas man in stand-your-ground case could get life

This undated picture made available by the Harris County Sheriff's Office shows Raul Rodriguez who was charged with murder in a triple shooting that left one man dead and two others injured during a dispute over the neighbor's loud party early Sunday, May 2, 2010. When music at a neighbor's party got too loud for his liking, Rodriguez - armed with a gun and a video camera - showed up to complain. The retired firefighter ended up in a verbal confrontation, telling a police dispatcher by phone he feared for his life and was "standing my ground." But Texas doesn't have the kind of law at the center of the Trayvon Martin slaying in Florida, and prosecutors trying Rodriguez for murder call him an aggressor who could have safely left his neighbor's driveway at any time. Danaher, 36, was killed in a confrontation over noise with neighbor Raul Rodriguez, who said he was "standing his ground" in the conflict. The incident involving Rodriguez, who is now on trial, happened two years before the shooting death in February of 17-year-old Trayvon Martin in Florida that sparked protests across the U.S., and spurred debate about whether race was a factor and in the initial police handling of the case. (AP) ? A retired Houston-area firefighter faces up to life in prison after a jury convicted him of murder for gunning down his unarmed neighbor during a dispute over a noisy house party.

Raul Rodriguez, 47, argued he was within his rights under Texas' version of a stand-your-ground law when he killed Kelly Danaher in 2010. The trial's punishment phase, which will include further testimony, was scheduled to begin Thursday.

Rodriguez was angry about the noise coming from Danaher's home, where the family was having a birthday party for Danaher's wife and young daughter. Rodriguez went to the home and got into an argument with Danaher, a 36-year-old elementary school teacher, and two other men who were at the party.

In a 22-minute video he recorded the night of the shooting, Rodriguez can be heard telling a police dispatcher "my life is in danger now" and "these people are going to go try and kill me." He then said "I'm standing my ground here," and shot Danaher after somebody appeared to grab his camera. The two other men were wounded.

Rodriguez's reference to standing his ground is similar to the claim made by George Zimmerman, a neighborhood watch volunteer who is citing Florida's stand-your-ground law in his defense in the fatal February shooting of an unarmed teenager, Trayvon Martin. Rodriguez's case, however, was decided under a different kind of self-defense doctrine.

Danaher's wife, Mindy, said she cried tears of joy and sadness after the verdict was read.

"I'm just glad that he can't hurt anybody else. That's my main thing," she said outside the courtroom. "I love my husband and I miss him so much."

Rodriguez's attorneys left the courtroom without speaking to reporters. His family, who sobbed after hearing the verdict, declined to comment. His attorneys did not present any witnesses in his defense.

Jurors deliberated for about five hours after having received the case following closing arguments earlier Wednesday.

During closing arguments, prosecutor Kelli Johnson said Rodriguez started the confrontation when instead of calmly asking Danaher to turn down the music he armed himself with a handgun and a camera and proceeded to harass people at the party.

Johnson said Rodriguez lured and provoked Danaher and two other men to come out onto the street and threatened them by brandishing his gun. Rodriguez did have a concealed handgun license. She said Danaher and the two other men were unarmed and that Rodriguez's life was never in any danger. Danaher's widow had told jurors her husband was not a confrontational person.

"This is not what stand your ground is," Johnson said. "Stand your ground is something the law takes very seriously. The law makes it very clear" when the law can be used.

Texas' version of the law, which is known as the Castle Doctrine, was revised in 2007 to expand the right to use deadly force. It allows people to defend themselves not only in their homes but also in their workplaces or vehicles. Legal experts say the expansion also gave people wider latitude on the use of deadly force.

The law also says a person using force can't provoke the attacker or be involved in criminal activity at the time.

Johnson said Rodriguez can't hide behind the stand-your-ground law because he provoked the confrontation and then brandished his weapon against an unarmed individual, which is a crime.

But defense attorney Neal Davis said he doesn't believe Rodriguez did anything illegal. He said Rodriguez went to complain and was confronted by Danaher and the two other partygoers, and that he didn't pull out his gun until he was standing in the street and Danaher approached him in a threatening manner.

"He had a right to be (in) the street. He was not provoking anybody. He was not engaged in any criminal activity. The (stand-your-ground) law is not only for home invasions. That's why the law was changed," Davis said.

An acquittal of Rodriguez would not "say everyone in the city of Houston is going to turn into the Wild, Wild West," Davis said.

Johnson told jurors prosecutors don't have any problems with guns in Texas.

"But with that comes a lot of responsibility. It has to be used as a last resort," she said.

Grant Scheiner, a Houston criminal defense attorney who was not involved in the case but who followed it, said a conviction in a case like Rodriguez's might prompt some clarification of Texas' stand-your-ground law that would more clearly define what it means to provoke someone. But he said he didn't foresee major changes in the law.

Black hole growth found to be out of sync

Tuesday, June 12, 2012

New evidence from NASA's Chandra X-ray Observatory challenges prevailing ideas about how black holes grow in the centers of galaxies. Astronomers long have thought that a supermassive black hole and the bulge of stars at the center of its host galaxy grow at the same rate -- the bigger the bulge, the bigger the black hole. However, a new study of Chandra data has revealed two nearby galaxies with supermassive black holes that are growing faster than the galaxies themselves.

The mass of a giant black hole at the center of a galaxy typically is a tiny fraction -- about 0.2 percent -- of the mass contained in the bulge, or region of densely packed stars, surrounding it. The targets of the latest Chandra study, galaxies NGC 4342 and NGC 4291, have black holes 10 times to 35 times more massive than they should be compared to their bulges. The new observations with Chandra show the halos, or massive envelopes of dark matter in which these galaxies reside, also are overweight.

This study suggests the two supermassive black holes and their evolution are tied to their dark matter halos and did not grow in tandem with the galactic bulges. In this view, the black holes and dark matter halos are not overweight, but the total mass in the galaxies is too low.

"This gives us more evidence of a link between two of the most mysterious and darkest phenomena in astrophysics -- black holes and dark matter -- in these galaxies," said Akos Bogdan of the Harvard-Smithsonian Center for Astrophysics (CfA) in Cambridge, Mass., who led the new study.

NGC 4342 and NGC 4291 are close to Earth in cosmic terms, at distances of 75 million and 85 million light years. Astronomers had known from previous observations that these galaxies host black holes with relatively large masses, but are not certain what is responsible for the disparity. Based on the new Chandra observations, however, they are able to rule out a phenomenon known as tidal stripping.

Tidal stripping occurs when some of a galaxy's stars are stripped away by gravity during a close encounter with another galaxy. If such tidal stripping had taken place, the halos mostly would have been missing. Because dark matter extends farther away from the galaxies, it is more loosely tied to them than the stars and more likely to be pulled away.

To rule out tidal stripping, astronomers used Chandra to look for evidence of hot, X-ray-emitting gas around the two galaxies. Because the pressure of hot gas -- estimated from X-ray images -- balances the gravitational pull of all the matter in the galaxy, the new Chandra data can provide information about the dark matter halos. The hot gas was found to be distributed widely around NGC 4342 and NGC 4291, implying that each galaxy has an unusually massive dark matter halo and that tidal stripping is unlikely.

"This is the clearest evidence we have, in the nearby universe, for black holes growing faster than their host galaxy," said co-author Bill Forman, also of CfA. "It's not that the galaxies have been compromised by close encounters, but instead they had some sort of arrested development."

How can the mass of a black hole grow faster than the stellar mass of its host galaxy? The study's authors suggest a large concentration of gas spinning slowly in the galactic center is what the black hole consumes very early in its history. It grows quickly, and as it grows, the amount of gas it can accrete, or swallow, increases along with the energy output from the accretion. After the black hole reaches a critical mass, outbursts powered by the continued consumption of gas prevent cooling and limit the production of new stars.

"It's possible that the supermassive black hole reached a hefty size before there were many stars at all in the galaxy," said Bogdan. "That is a significant change in our way of thinking about how galaxies and black holes evolve together."

The results were presented June 11 at the 220th meeting of the American Astronomical Society in Anchorage, Alaska. The study also has been accepted for publication in The Astrophysical Journal.

Samsung aiming for complete mobile domination with rumored Facebook competitor

Samsung aiming for complete mobile domination with rumored Facebook competitorSamsung's made no secret of its ambitions to commandeer all aspects of mobile tech -- from the devices themselves to processors and software like ChatON and the recently announced Siri competitor S Voice. While we've seen the company head into social media territory before, it looks like it wants an even bigger piece of that pie. According to The Korea Times, Sammy is gearing up to launch a Facebook-style service early next year. The network, code-named (rather transparently) Samsung Facebook, will supposedly be integrated with Amazon's cloud computing platform, and the company is using its already-existing Family Story network as a starting point for the service. And lest you think the company sees edging out Facebook as a serious challenge, it hopes to expand its social media service "across different devices from different companies across different mobile platforms."

With Obamacare Still In Play, GoHealth Lands $50M For Health Insurance Comparison Shopping

Screen shot 2012-06-13 at 1.54.32 AMThis month, the Supreme Court is expected to rule on the constitutionality of the Affordable Care Act (also known as Obamacare), deciding whether or not adults in the U.S. will be required to purchase healthcare. If the Court rules in favor, millions of Americans will soon be in the market for health insurance. This would be a boon for companies like GoHealth, the Chicago-based tech company behind GoHealthInsurance.com, an online portal that allows consumers to comparison shop for health coverage. That's part of the reason that GoHealth is taking on a $50 million equity investment from middle market investment firm, Norwest Equity Partners. In the event the individual mandate does pass, GoHealth wants to be ready for a potentially huge flock of irritated healthcare shoppers.

Discoveries unfathomable only a few years ago are reality today at the Texas AgriLife Genomics and Bioinformatics Service with the acquisition of next-generation sequencing technology on the Texas A&M University campus in College Station, said the director of the service.

"As we move into the genome-sequencing era, we are entering a truly amazing period in history," said Dr. Charles Johnson, director of the service. "Our mission is to facilitate scientific discoveries by guiding and empowering scientists across the Texas A&M University System over an increasingly complex and technologically advanced terrain."

The genomics and bioinformatics service was established in the fall of 2010, but it is the recent purchase of the Illumina HiSeq 2500 next-generation sequencing system that will give the team led by Johnson the capability to make a huge impact on crop breeding.

"Although focused on plant breeding, this machine has the potential to sequence the equivalent of the human genome in one day for as little as $1,000," Johnson said. "It took more than 13 years to do the original human genome project, and cost $2.7 billion.

"We can also mix large numbers of samples within one lane using sequencing-based bar coding to provide cheaper per-sample pricing," he said, "which in turn leads to larger studies and greater scientific discoveries."

One of the keys to this technology is bioinformatics analysis, or analyzing the tidal wave of data and turning it into usable information, Johnson said. AgriLife has invested significant resources in this area as well.

He compared it to a giant puzzle, and the team of bioinformaticians, geneticists, statisticians, mathematicians and computer scientists are the ones who put the DNA information pieces together to make the complete picture.

Dr. Bill McCutchen, AgriLife Research executive associate director, said this genomics capability will be of particular importance to the wheat breeding program.

"This provides our scientists with the capability to quickly advance important traits that we find in our multiple research plots across Texas, traits such as drought tolerance," McCutchen said. "The molecular-marker system provides a genetic road map of sorts, and we can now advance our breeding and agronomic research programs at a much faster pace."

Johnson said AgriLife scientists are now able to connect the genetic information from large numbers of breeding populations to a wealth of phenotypic information, making the connection between genes and resistance to drought, disease and insects, as well as other high-value traits leading to increased yields over a broad range of conditions.

Instead of looking at one or two markers at a time, "we can look at hundreds of thousands of markers at one time," he said.

"We now have the ability with genomics to integrate and develop superior wheat varieties for yield, drought tolerance, quality and other traits in a much shorter period of time as compared to conventional means of breeding," McCutchen said. "By combining our strong breeding, pest management and agronomic expertise with genetic knowledge, we, AgriLife, are able to produce significant advancements across cropping systems."

Both McCutchen and Johnson said this technology applies to all crops, livestock, diseases and human health anything with DNA.

"AgriLife Research, in a visionary effort, has launched this center and made it available to the entire Texas A&M University System," Johnson said. "We are not a for-profit center, but it takes a significant amount of money to keep the doors open.

"Our goal is to provide the best possible sequencing and bioinformatics service for all our collaborators, and through that effort, provide the greatest possible return to the citizens of Texas and the world by way of revolutionary new discoveries."
