Marine wife's murder linked to 'sex dungeon'

By NBC News staff and wire reports

Three roommates involved with a "sex dungeon" at their home may have murdered a Marine's wife in California as they tried to satisfy their fetishes, investigators say in newly unsealed search warrants.

Detectives found "bondage type sex apparatuses, toys and tools" at the home of the two women and man who have been charged with murder in the death of 22-year-old Brittany Killgore. Her body was found near a Southern California lake on April 17, less than a week after she was reported missing.

Investigators believe all three suspects were with Killgore at their home in Fallbrook, north of San Diego, shortly after the victim sent a desperate text message to a friend, "Help."

Killgore was last seen April 13 in a borrowed purple evening gown, three days after she filed for divorce from Lance Cpl. Cory Killgore, who was serving in Afghanistan at the time. The documents say her body was found with neck injuries consistent with strangulation and marks on her wrist and leg that suggested someone tried to use a saw or other tool to dismember her.

A San Diego County sheriff's detective said in one affidavit that the trio may have targeted Killgore for their "unusual sexual fetishes." Louis Ray Perez and Dorothy Maraglino told authorities they were involved in "master, servant and slave role playing."

AP Photo/San Diego County Sheriff's Department

The third suspect, Jessica Lopez, said she strangled the victim, fearing the victim would upend a kinky sex ring by seducing her "Master," according to the warrants. Lopez wrote in a seven-page letter that she believed Killgore was trying to come between her, Perez and Maraglino. All three have pleaded not guilty.

Lopez, who calls Perez her "Master," shoulders full blame for the killing, according to the warrants, saying she acted after the victim told her that she had a "whole night planned" with Perez, comments suggesting jealousy was a motive.

Lopez, 25, said she had been burned before in a relationship and knew what she had to do when Killgore entered their Fallbrook home. Lopez said she shot the victim with a stun gun, wrapped a rope around a neck, buried her face in a pillow and strangled her.

"She barely moved but she just wouldn't die, the miserable whore," the letter said.

Lopez said she made "a few attempts to chop her up" with Perez's power tools and doused Killgore's body in bleach to get rid of evidence before dumping the nude body near Lake Skinner, near Riverside.

The documents give no indication that Killgore knew about the sex ring, and prosecutors call her an innocent victim. Detectives said she accepted Perez's invitation to a San Diego dinner cruise after Perez helped her move that afternoon. The warrants do not say how Killgore met the suspects.

Sloan Ostbye, Lopez's attorney, joined the San Diego County district attorney's office in an appeal to keep the documents sealed, calling much of her client's letter "false or at least misleading and possibly delusional."

In her letter, Lopez told police she wasn't responsible for the killing. Detectives found it in a San Diego hotel where Lopez was discovered with self-inflicted cuts four days after Killgore disappeared.

The handwritten letter ? below a mirror that was scrawled with the word "PIGS READ THIS" ? accused police of "complete incompetence." It is laced with profanity and poor punctuation.

The letter says where the body was dumped, telling police they would likely find handcuff marks on the wrists. It says the handcuffs and a knife were disposed at a beach restroom in Oceanside.

Three days after Killgore vanished, detectives searched Perez's mud-caked 2001 Ford Explorer and found a plastic bag with a stun gun, latex gloves and Killgore's blood. Perez's DNA was found on the stun gun.

The documents describe an elaborate ruse for Perez to conceal his whereabouts on the night Killgore vanished.

The Marine told detectives he picked up Killgore for the dinner cruise but instead dropped her off at a downtown San Diego nightclub. He said he couldn't find her at the club after parking and returned home.

Killgore's and Perez's cell phones remained in Fallbrook that night, contradicting his statement that he was in San Diego, according to authorities.

Killgore sent a text message to a friend that said, "Help," at 7:50 p.m., about 13 minutes after Perez picked her up. The friend asked if she was OK and insisted she call. About two hours later, the friend got a response, "Yes I love this party," which fueled suspicions because Killgore always texted 'yeah' instead of 'yes' and had said nothing about going to a party.

A transient found Killgore's phone at his feet when he woke up in the doorway of a downtown San Diego hotel that night. A San Diego County sheriff's detective said he believed Perez drove downtown to get rid of the phone.

All three defendants are being held on $3 million bail. A preliminary hearing is scheduled Aug. 21.

Some Options for Reducing Your Tax Debt with the IRS

So you owe a lot of taxes? Groan! That's not a very happy condition, and it's probably stressful for you?but it's not the end of the world. There are several things you can do to ease the pain. Here are some possibilities you should know about.

1. ?YOU COULD MAKE AN INSTALLMENT AGREEMENT WITH THE IRS
If you don't have all the money to pay off your tax bill all at once, you can set up a monthly payment plan with the IRS. There are four types of agreements.

a) ?Guaranteed Installment Agreements
The IRS is required to agree to an installment plan if your balance due is $10,000 or less, all your tax returns have been filed, and you agree to file your tax returns on time in the future.

b) ?Streamlined Installment Agreements
You can qualify for a streamlined installment agreement if the balance you owe the IRS is $50,000 or less and you pay off the balance in 72 months or less.

All your tax returns must be filed and you must agree to file your tax returns on time in the future.

c) ?Partial Payment Installment Agreements
If your income cannot handle the minimum payments for either the guaranteed or streamlined agreements, you might qualify fora partial payment agreement in which the monthly payment is based on what you can afford. It can be set up to cover a longer repayment term and the IRS will probably file a federal tax lien to protect its interests. The IRS will re-evaluate the terms of this agreement every two years to see if you might be able to pay more.

d) ?Non-Streamlined Payment Agreement
If your balance due is over $25,000, or you need a repayment term longer than five years, or you don't meet any of the criteria for a streamlined or guaranteed installment plan, you can set up your own terms for with the IRS, but approval is not guaranteed.

The IRS will likely ask that you attempt to sell assets, take out a bank loan, or get a home equity loan so you can pay off the IRS without needing this kind of agreement.

2. ?YOU COULD MAKE AN OFFER IN COMPROMISE TO THE IRS
Sometimes the IRS will accept less than full payment (including penalties and interest) if there is doubt as to whether it will ever be possible for you to pay the full amount or if there is doubt as to whether you are actually liable for the full amount.
You must prove that the amount you are offering meets the standards set by the government as to the "Reasonable Collection Potential." It is basically the liquidation value of your assets, such as cars, real estate, and personal property, plus your monthly disposable income over a period of four or five years.

3. ?YOUR DEBT COULD BE DECLARED CURRENTLY NOT COLLECTIBLE BY THE IRS
In extreme cases the IRS can declare a taxpayer's bill as "currently not collectible"and agrees not to collect on the tax debt for a year or so.The collectability status will be continually re-evaluated.

4. ?BANKRUPTCY
Income tax debts may be eligible for discharge under Chapter 7 or Chapter 13 of the Bankruptcy Code. There are strict criteria you must meet to have your taxes discharged.

5. ?PENALTY ABATEMENT
Penalty abatement can be right for you if you can pay the tax liability owed, but believe you should not be held liable for the penalties incurred. This program allows you to pay your tax bill without penalty or interest.

Gym member gets nearly $893K after barbell fell on?face

July 16, 2012 at 3:00 pm

Plaintiff claimed trainer dropped barbell on face

Verdict: (P) $892,650.00
Case Type: Negligent Training, Recreation ? Gym, Affirmative Defenses ? Assumption of Risk
Case Name: Assaf Blecher v. 24 Hour Fitness USA Inc. and David Stevens, No. BC433630
Venue: Superior Court of Los Angeles County, Central, CA
Judge: Robert L. Hess
Date: 03-28-2012

Plaintiff(s):

Attorney(s):

Defendant(s):

Attorney(s):

  • Jack C. Nick; Prindle, Amaro, Goetz, Hillyard, Barnes & Reinholtz, L.L.P.; Long Beach, CA, for 24 Hour Fitness USA Inc., David Stevens

Expert(s):

  • Eric Sternlicht Ph.D.; Health & Fitness; Orange, CA called by: Jack Nick

Facts:

On Jan. 26, 2010, plaintiff Assaf Blecher, 38, a member of the 24 Hour Fitness facility, was participating in a personal training session with his trainer, David Stevens, an employee of the gym, when the trainer dropped a 145-pound barbell on Blecher?s face.

Blecher sued Stevens and 24 Hour Fitness USA Inc. He alleged that Stevens was grossly negligent in the handling of the barbell, and that the fitness facility was liable for trainer?s actions and for negligently training Stevens.

Plaintiff?s counsel contended that Stevens? actions constituted gross negligence by failing to follow safety procedures that were the standard in the fitness industry, such as gripping the barbell in the proper manner, undertaking spotting responsibilities for weight that was heavier than he could handle at the time, and failing to seek assistance once he recognized Blecher?s exhaustion. Counsel also contended that the fitness center was grossly negligent in its failure to properly educate its trainers on safety techniques that could have prevented or minimized the risk of injury.

Defense counsel argued that the neither the actions of Stevens nor 24 Hour Fitness constituted gross negligence, and that Blecher assumed the risks associated with the activities. Counsel also argued that Blecher was at least partially negligent for the accident because he did not hang onto the bar.

Defense counsel moved for summary judgment based on the signed liability waiver that is contained within the membership agreement. Plaintiff?s counsel opposed the motion by alleging that the actions of the trainer and the club constituted gross negligence, which would be outside the scope of the release, per City of Santa Barbara v. Superior Court (2007) 41 Cal.4th 747,758. The court ultimately denied the defense counsel?s motion.

?

Injury:

Blecher sustained nasal fractures and cheek bone fractures, and was subsequently transported to a hospital, where an emergency plastic surgery was performed. It was also determined that Blecher suffered nerve damage to the infra orbital nerve as a result of the facial fractures and he ultimately developed a temporomandibular joint disorder.

Blecher claimed that the nerve damage caused a permanent loss of sensation to part of his face.

?

Verdict Information:

The jury found that both Stevens and 24 Hour Fitness were negligent, and awarded Blecher $892,650 in damages.

?

Assaf Blecher

$142,650 Personal Injury: special damages

$750,000 Personal Injury: general damages

Synthetic Biology Scorecard finds federal agencies responding to bioethics report

Some progress being made

WASHINGTON Federal agencies have started taking steps to address the recommendations in a 2010 report from the presidential bioethics commission to improve the governance of synthetic biology research and development, though the government has not fully addressed any of the report recommendations, according to a scorecard tracking the efforts.

The Synthetic Biology Project at the Woodrow Wilson International Center for Scholars launched the web-based Synthetic Biology Scorecard in February to track federal and non-federal efforts to implement the recommendations in New Directions: The Ethics of Synthetic Biology and Emerging Technologies, a December 2010 report from the Presidential Commission for the Study of Bioethical Issues. The recommendations seek to minimize risks from the technology while ensuring that social and economic benefits are realized.

Eighteen months after the release of the report, information collected by the Project and submitted by users finds that steps have been taken by the U.S. government over the past four months to continue addressing the report recommendations. These measures include a new White House-led interagency working group looking at government work on the issue; a recent six-party meeting at the National Academy of Sciences (the last in a series of three meetings between the United States, United Kingdom and China); and the development and release of the National Bioeconomy Blueprint.

Still, the Scorecard finds that none of the recommendations have been fully addressed, including six recommendations that called for federal action within 18 months, or by mid-June 2012. Of the six recommendations calling for action within 18 months, five of the recommendations saw some level of government activity.

Of the 17 recommendations tracked by the Scorecard, 13 had some level of federal activity and four had no activity, including a recommendation calling for risk assessments before research organisms or commercial products involving the technology are released into the environment and a recommendation calling for the identification of reliable containment and control mechanisms.

President Obama requested the Commission's report more than two years ago in response to important advancements in the field of synthetic biology. On May 20, 2010, scientists at the J.C. Venter Institute unveiled a bacterial cell controlled by a synthetic genome. The same day, the president asked the Commission to study "the implications of this scientific milestone . . . [and] consider the potential medical, environmental, security, and other benefits of this field of research, as well as any potential health, security, or other risks."

The Scorecard has new features to improve usability. People are encouraged to submit work by agencies, organizations, states and others that fulfill the Commission recommendations. The Project plans to continue to highlight the progress towards implementing the recommendations.

Modern Eye Care-Beverly Hills eye doctor - PDF

Modern Eye Care
Just because the economy is going through a tough
times doesn't mean that you can afford to spend less on
your health and the health of your family- even during times
of tighter budgets, people wil continue to get sick, teeth wil
continue to get cavities, and eyesight wil continue to
worsen. These days, especial y in developed countries,
eyesight seems to be getting worse and worse. Experts have
stated that the aging baby boomers population and an
increase in diabetes and computer use-related eye diseases
are to blame for the progression of worsening eyesight. This,
however, has been good news for the optometry industry in
the recent years: it has been growing at an annual rate of
2.9%, with expected revenues of $14.0 bil ion in 2012.
Although there have been some who have been putting off getting their eyes checked due to
the economic environment causing high unemployment rates and therefore lower disposable income,
many continued to seek eye care during the recession as optometrists reduced their prices in order to
meet the financial capabilities of their clients, and those who put off getting their eyes checked are
beginning to make appointments at their local Beverly Hills eye doctor.
It is recommended that children get their eyes examined every one to two years; if a child was
born prematurely, has developmental issues, sustained an eye injury, has crossed eyes, or is at risk of
developing a hereditary eye disease, his or her eyes should be checked more regularly. For adults ages
20 to 39 who already wear glasses, it is recommended that they visit their optometrist every year in
order to maintain current prescriptions, and for the adults who have not previously worn glasses and are
not experiencing vision/eye problems, it is recommended that they visit their optometrist every two to
three years. Once a person turns 40, he or she should schedule an eye exam, and if no problems are
found, he or she should visit the optometrist every one or two years. However, if it is found that
corrective lenses are needed or that an eye condition has developed, how often the patient should visit
the optometrist thereafter wil vary depending on the severity of the patient's eye problem. After the
age of 60, everyone should schedule annual eye exams, regardless the existence of previous eye
conditions.
Depending on the patient's preferences, there are a few different modern options for correcting
vision problems: glasses, contacts, and Lasik. Glasses are probably the least flexible option of the three:
the patient has peripheral-vision limiting eyewear on his or her face at al times. Contacts are more
flexible than glasses, since peripheral-vision is not compromised, and are negligible in price difference in
comparison to glasses. Beverly Hills Lasik is the most flexible option of the free since the patient's vision
is corrected to such an extent that neither glasses nor contacts are required, cutting down on
optometrist appointment fees and the cost of updating glasses/contacts; the average 20 year-old who
wears glasses/contacts can save up to $48,000 during his or her lifetime by getting Lasik.

Carol Baldwin is a non-fiction author who has written great resources for writers and teachers of writing.? She?s a professional writing instructor at colleges, conferences, and schools, and her book: ?Teaching the Story: Fiction writing in grades 4-8 is an excellent example of a book for a new millennium.? Filled not just with words on paper, Teaching the Story is available in both print and partial-ebook formats and comes complete with downloadable reproducible hand-outs and activities via a CD program.? It?s received rave reviews from middle school teachers and authors alike.? Carol is a well-loved member of the SCBWI and is a fixture at the SCBWI Carolina?s annual conference, as well as conferences around the region, where she is often a presenter. ?The three Gs in her life are gardening, grandchildren, and learning how to golf, and she is?finishing up a YA historical novel as well.?

So tell us, Carol, you often teach the rest of us about writing.? But is there also an author or other publishing professional who has helped and guided you as you have progressed in your career as a writer? Definitely. The person who has been the most helpful to me is Joyce Hostetter, author of Best Friends Forever, BLUE, COMFORT, and Healing Water.? Joyce and I met at a reading and writing conference where we were both presenting.? We discovered mutual interests and began collaborating on teacher workshops, professional conferences, and Talking Story, a digital newsletter for librarians, teachers, and home educators.? I found a ?kindred spirit? as Anne Shirley of Anne of Avonlea once said. Throughout our friendship and professional association, Joyce has never stopped encouraging me as a writer.? When I get down about how long it has taken me to complete my novel, she always reminds me that it is a process and that books have layers?which aren?t written at one time. She has edited and ?tweaked? (her favorite word!) my synopsis and contest submissions?and as a result I have learned how to tighten my writing and include the most important details in my story. Her encouragement and support have been priceless. Now as I teach other writers, I realize that I am passing along what I learned from her. That?s great, Carol!? Joyce definitely does have a lot that she can teach all of us.? Just reading the brilliant first page of Healing Water will tell you that! I also think it?s great that you and Joyce have collaborated on the ?Talking Story? digital newletter. ?Several of the recent topics really caught my eye including: ?The revision process, poetry, fantasy, and picture books for all ages.? ?It seems like a very comprehensive list. What a great resource for all of us writers out here in the professional world!? I hope that many authors reading this blog post will sign up for Talking Story straight away.? So in addition to publishing Talking Story, and speaking at many SCBWI and other writing and teaching-related conferences, how else would you say you reach back and reach out to other writers to help them learn new skills and move forward in this profession? As the critique group coordinator for a SCBWI critique group in Charlotte for over 15 years, I have reached out to many writers?both novices and those who are further along their path to publication. I tell everyone to join SCBWI since it is a great source of information and support.? In the same way, when I have led workshops at teachers and writers conferences, at NCCAT?(North Carolina Center for the Advancement of Teaching), or when I teach writing at my local community college, I pass along what I have learned about writing and the publishing industry. That?s great, Carol.? I know that you have a wonderful reputation of helping many professional writers learn more about the craft!? Can you give us a few secret little tips that you usually share with other authors when they ask you for guidance? Of course!? The most consistent bits of advice that I give are: ????????? Writing involves rewriting. ?Always. ????????? Read a lot. Learn from other authors-- in your genre and in other genres. ????????? Persevere. It?s not easy to get published, but it is possible. ????????? Start small with the magazine market. Belinda Hurmencetaught me that over 20 years ago and it helped me gain publishing experience and credits. ????????? Hone your craft. ? Thanks Carol! Those are all great bits of advice!

One thing I?ve noticed about you, Carol, is that you seem to have really established a niche in teaching writing -- providing great presentations at conferences, and doing a lot of speaking in the schools and to teacher groups.? I personally attended a presentation you gave a few years ago on ?writing for the educational market? and found it extremely helpful, well-resourced, and informative!? I went home with a whole packet of things to think about, websites to look up, and topics to pitch.? It was great! I know there are many other children?s and YA authors who would like to get more involved in speaking at conferences and interacting with teachers and librarians and students in the schools to promote their books and to promote the love of reading and writing.? Can you give other authors any tips on how to go about finding opportunities to speak in the schools or to teachers, librarians or authors? Yes. Since my most recent book, Teaching the Story: Fiction Writing inGrades 4-8? ?was for the educational market, I learned the importance of attending and presenting at teachers? conferences. I also saw how teachers LOVE meeting authors!? Last year at the fall SCBWI-Carolinas conference I summarized what I learned during the years I spent researching educational conferences, preparing PowerPoints, and delivering interactive workshops. If you email me at cbaldwin6@carolina.rr.com I can send you a pdf of the PowerPoint. I now teach at Central Piedmont Community College because I called the continuing education department and said I was interested in teaching writing for children. Since then I have added two other classes to my repertoire. All of these teaching opportunities take time and energy and passion. I have taught homeschool and give writing workshops at local libraries. Again, you have to invest time in reaching out to the homeschool community and libraries in your area. But if you love writing and enjoy teaching, they are great opportunities to become known in your community. Thanks Carol, that?s a great starting point for us.? Huge thanks for your willingness to share your PowerPoint presentation on this theme with us for free.? That?s a great gift to all those interested in this topic! Here?s a fun question.? I know that writing is an integral part of your life now as an adult.? How old were you when you first started writing? I have been journaling for as long as I can remember and had several pen pals growing up.? I think that all of these writing activities trained me for translating thoughts into the written word. My first ?published? piece was a short poem I wrote for a magazine my father subscribed to. I was probably 10 or 12 and was so proud of it! My mother, (who at 88 is still one of my biggest fans,) encouraged me as I grew up by saying, ?You have a way with words.? Parents should never underestimate their power to inspire their children. That?s so true, Carol.? Parents, teachers, authors, mentors ? we should all inspire the children in our lives to go for their dreams, and to build a love of writing. Exactly. My dream, ever since I read Cynthia Voigt?s books thirty years ago, was to write fiction for young adults. I loved how her stories showed young people overcoming the challenges in their lives. I still remember scenes out of Dicey?s Song! Up until about six years ago I felt very comfortable writing nonfiction, but the nagging feeling to try fiction wouldn?t go away. I took the plunge and attempted to write a picture book about a bird sanctuary in Charlotte. The project morphed into a boy?s chapter book, then a middle grade reader for girls, and now Half- Truths ?is historical fiction for young adults. The story takes place in the south in 1950, when two teenage girls--one black and one white--break racial restrictions, uncover family secrets, and form a friendship which revolutionizes their families.??I am in the middle of rewriting the book from both girls? points of view after receiving that advice from Mary Cate Castellani at last year?s SCBWI Carolinas conference. She suggested that it would open the book to a wider audience; which I hope will prove true! ?But one thing is for sure, each time I receive a critique I grow as a writer. The journey you?ve had with that manuscript so far is an excellent example of a point you made earlier, I think, Carol. You said: ?Writing involves re-writing. Always.?? You are such a good example to us, because it seems like you?re definitely taking your own advice! J Thanks so much for being here with us today, Carol, and for sharing just the beginning of your wisdom! For those interested in more great writing tips from Carol, check out her blog www.carolbaldwinblog.blogspot.com and don?t forget to sign up for the Talking Story newsletter. Next week we?ll be right back here Saturday morning with an interview from Illustrator/Author and ARA of the SCBWI Carolinas Region, Bonnie Adamson, followed in the weeks to come by interviews with multi-published children?s author Stephanie Greene, ?a new shooting star in the YA publishing world, Megan Shepard, plus more.? Thanks again, Carol. Write on.
